Terms of Service for SerpWeb

Please read these Terms of Service ("Terms") carefully before using the SerpWeb service (the "Service") operated by SerpWeb Inc. ("us", "we", or "our").

1. Agreement to Terms

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

2. Subscriptions

Some parts of the Service are billed on a subscription basis. You will be billed in advance on a recurring and periodic basis ("Billing Cycle"). Billing cycles are set on a monthly basis. At the end of each Billing Cycle, your Subscription will automatically renew under the exact same conditions unless you cancel it or we cancel it. You may cancel your Subscription renewal either through your online account management page or by contacting our customer support team.

3. Accounts

When you create an account with us, you must provide us information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service. You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password.

4. Data Processing

To provide our Service, we process the data you submit, including domains, keywords, and competitor information. This processing is essential for delivering core features like rank tracking, historical data analysis, and competitor benchmarking. We do not share your specific tracking data with third parties, except as necessary to operate the Service (e.g., interacting with search engine data providers).

5. Service Level Agreement (SLA)

We strive to ensure our Service is available 99.9% of the time ("Target Uptime"). However, we do not offer financial compensation or credits for downtime. In the event of a significant service interruption, we will work to restore access as quickly as possible and may, at our discretion, provide account credits or other forms of compensation.

6. User Conduct and Fair Use

You agree not to use the Service for any unlawful purpose or any purpose prohibited under this clause. You agree not to use the Service in any way that could damage the Service, the business of SerpWeb, or any user of the Service. To ensure service stability for all users, you agree not to engage in excessive or automated querying of our Service that could degrade performance. We reserve the right to throttle or suspend accounts that violate this Fair Use Policy.

7. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.

8. Limitation of Liability and Data Accuracy

In no event shall SerpWeb, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service. While we strive for the highest possible accuracy in the ranking data provided, we are not liable for any business decisions or financial losses incurred based on this data. Search engine results can fluctuate frequently and are outside of our control.

9. Governing Law

These Terms shall be governed and construed in accordance with the local laws, without regard to its conflict of law provisions.

10. Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will try to provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
